Herstory (허스토리, Min Kyu-dong, 2018)

When Kim Hak-sun held a press conference and offered her testimony as a former comfort woman following a statement in the Japanese Diet in which the government rejected any responsibility for wartime sexual slavery, it brought an issue into the public consciousness that many had been unwilling to reckon with. One of many films focussing on the same subject released in the last few years, Min Kyu-dong’s Herstory (허스토리) dramatises the events of the Shimonoseki Trials which took place between 1992 and 1998 and resulted in the first admission from the Japanese authorities that the basic human rights of women had been breached but nevertheless found it not incumbent on the government to offer a direct apology. 

That the trial takes place in Shimonoseki is itself somewhat symbolic, given that this was the harbour from which boats to Korea and China departed and at which the women who were trafficked to Japan would have arrived. The film begins, however, in Busan where successful travel agent Moon Jung-sook (Kim Hee-ae) has ironically been accused of breaking the prevention of prostitution laws when a Japanese man is found dead after visiting a sex worker and it is revealed one of her employees had been running tours specifically geared towards sex tourism. Struck by Kim Hak-sun’s testimony, the association she leads of female business owners wants to do something to help and seeing as her company has been suspended, Jung-sook sets up a call centre on her premises for other victims of wartime sexual slavery and forced labour to come forward. 

Unlike some of the recent dramas dealing with the same issue, Min focusses on the resistance towards the former comfort women coming from within Korea itself. A taxi driver Jun-sook gets a lift from goes off on a rant describing the women as former sex workers out for a paycheque who should be ashamed of their sordid pasts while in any case all of this happened decades ago so why bring it up now? He is far from alone, even the Mayor describes them as “filthy women” when Jung-sook approaches him for help, and it’s obvious that many find the subject so embarrassing that they simply do not want to discuss it and blame the women for breaking the peace by speaking out. 

It’s also true that in the peculiarities of the political landscape of Korea, conservative elements tend to hold a more favourable view of Japan and the colonial era than might be expected. Economically, there are strong ties and Jung-sook, a fluent Japanese speaker, has close business relationships with Japanese clients which are endangered by her involvement with the comfort women cause. Her friend in the women’s association who runs a traditional-style hotel can be seen warmly greeting Japanese guests, at one point as she expresses her admiration for Kim Hak-sun in Korean to the television as they pass behind her. It’s clear that some would rather not rock the boat because this kind of politicking is often incompatible with running a successful business. 

Jung-sook is minded to buck the trend because she sympathises with the women’s suffering and with their rejection by mainstream society. She has the confidence to do this in part because the wealth she has accrued through business success gives her an unusual amount of power in a male-dominated, capitalistic society. Still she too struggles with contemporary notions of proper womanhood in being accused of neglecting her daughter through her workaholic lifestyle especially as she is considering leaving education claiming that studying isn’t for her. Even so, the women’s association seems to have female solidarity at its heart, collecting money to support single mothers even before taking up the cause and trying to help elderly women who have no remaining family members or means to support themselves. 

As she later comes to realise, the trial has meaning outside of winning and losing in allowing the women to express their trauma and regain some of their dignity. Even so, they are subject to further rejection in Japan, not least from a hotel which asks them to leave because other guests are unwilling to share the space with former sex workers. The Korean-Japanese lawyer also relates having faced racism in his life in Japan because of his Korean ethnicity while his mother’s restaurant is later graffitied because of their support of the case. Right-wing nationalists also hold protests outside the court and in Seoul accusing the women of lying, insisting that they are just “sex workers” as if sex workers weren’t worthy of human consideration anyway. In interpreting the testimony, Jung-sook becomes a kind of everywoman speaking for all women in her emotionally charged translation while inwardly conflicted in realising the toll the process is taking on some of the witnesses who are all in advanced age and often poor health. Min depicts their struggle with as much empathy as possible, avoiding the temptation to demonise while instead presenting a more nuanced perspective focussing on the women themselves and the rejection they continue face even within their own society.

The Prayer (간호중, Min Kyu-dong, 2020)

“I’m just wondering if they all live with nothing to live for and whether it has any meaning to live like that. And if I am no different.” a beleaguered daughter muses contemplating her own future while caring for her mother (Moon Sook) who has been bedridden in a coma for the last decade. A perhaps controversial advocation for euthanasia, Min Kyu-dong’s expansion of his entry into the SF8 series The Prayer (간호중, Ganhojung) offers a timely exploration of the nature of empathy, the limits of AI technology, the ageing society, and the destructive effects of inequality as mankind’s children find themselves wracked by the existential pain of human suffering. 

Set in the near future in which high schools are bulldozed to build additional care centres, The Prayer revolves around the relationship between the melancholy Jung-in (Lee Yoo-young) worrying if prolonging her mother’s life in this way is really what she’d want, and the robotic care nurse she’s hired to look after her, Ho-joong (also Lee Yoo-young). As we discover, Jung-in has taken advantage of the offer to have herself listed alongside her mother as a target for care leaving Ho-joong with an ironic conflict torn between her duty to look after Jung-in’s mother and witnessing the toll caring for her is taking on Jung-in who frequently expresses depressive thoughts and potentially suicidal ideations. 

In order to provide comfort to patients, the androids are designed with the same face as the primary guardian, meaning Jung-in is in someways in dialogue with herself while Ho-joong becomes increasingly confused in her imperfect, in some ways childish, application of human empathy. Fixated on Jung-in with a devotion which turns towards the romantic, she comes to the logical conclusion that in order to save her secondary patient the obvious choice is to sacrifice the first but has seemingly no understanding of the effect that may have on Jung-in who may be worn out and emotionally drained but would obviously feel responsible should anything happen to her mother at the hands of the robot nurse she hired because she has developed unintended feelings towards her. 

The extent of Ho-joong’s “feelings” are indeed at the heart of the matter as evidenced by her strange conversations with a well-meaning nun, Sister Sabina (Ye Soo-Jung), who is originally dismissive unwilling to recognise that a manmade creation may also desire access to God. As incongruous as it sounds, Ho-joong’s awakening spirituality positions her as uniquely human and as trapped as one of her patients, tormented by the pain of being alive and finally confined to table on which she claims to be experiencing near torture at the hands of those seeking to understand her “malfunction”. Her German manufacturers locate the fault in her advanced language processing unit, as if the problem were that she understands too well when perhaps it’s more that her empathy is based in a different metric and prone to misunderstand the irrationality of human impulses towards guilt and love. 

That’s also the problem with the unit next door owned by Mrs. Choi (Yum Hye-ran) whose husband (Yoon Kyung-ho) seems to be suffering from advanced dementia which often causes him to become violent or unpredictable. Unlike Jung-in, however, Mrs. Choi could only afford a basic model which offers little in the way of empathy nor will it care for her. Consequently, she appears to be overburdened with her husband’s care, doing laundry and tidying up after his frustrations cause him to trash his hospital room. The machine offers her only censure while the duty of care ironically prevents her from attending to her own health. Seeking help she turns to the manufacturer who bluntly tells her she doesn’t understand how to operate the machine and advises she ask her kids to teach her, only it appears that Mrs. Choi may have had a child in the past from whom she has become estranged and is otherwise all alone. Older than Jung-in, she despairs for the quality of her life and has no one to protect or care for her, pushing her towards a dark decision. 

Both women wonder if life is worth living if it means living like this, but have very different options open to them given their economic disparity. Having learned to feel pain, Ho-joong begs to be freed of it, positions now reversed as Sister Sabina becomes her caregiver. She accuses the nun of hypocrisy, that she allows her suffer by refusing to end her pain in order to preserve her own conscience in insisting to do so would be a “sin”. “What do I go through this pain for!” Ho-joong cries as if throwing herself into a fiery pit of existential torment while a cold authority insists she must continue to suffer. Min makes a powerful if perhaps controversial argument for the right to end one’s own suffering at a time of one’s own choosing if also leaning uncomfortably into the burdens of care as Mrs Choi and Jung-in too struggle with themselves while trying to do what’s best for those they love, but ultimately discovers a kind of serenity as his robot nurse encounters the spiritual and with it a release form the pain of living. 


The Prayer streamed as part of this year’s New York Asian Film Festival. It will also screen in London on 22nd October as part of this year’s London East Asia Film Festival.

New Trial (재심, Kim Tae-yun, 2017)

new trialIt’s a strange paradox that in a land defined by corruption of the legal system, your only hope my lie in a new trial. So it is for the hero of Kim Tae-yun’s latest film. Inspired by a real life miscarriage of justice (a case which was in fact still continuing at the time of filming), New Trial (재심, Jaesim) takes aim at everything from social inequality to unscrupulous lawyers and abuse of police power. A teenager pays dearly for being in the wrong place at the wrong time, not only losing 10 years of his life but the entire possibility of his future now that he’s forever branded a criminal. That’s aside from leaving his ageing (now blind mother) alone with no means of support and the additional burden of trying to clear her son’s name.

In the year 2000, reckless teen Hyeon-woo (Kang Ha-Neul) gets himself mixed up in the stabbing of a taxi driver. Despite sticking around to do his civic duty, he gets arrested, tried, talked into a false plea bargain confession and serves 10 years behind bars. Hyeon-woo might have been released after serving his time but he’s not the carefree kid he was before. Sullen, angry, and an ex-con without qualifications, he can’t find a job and has the additional burden of trying to care for his now blind mother. Even if he technically confessed to the crime because his conviction was inevitable and he wanted to get out faster so his mother wasn’t left alone, Hyeon-woo has his hopes permanently fixed on a retrial so he can clear his name once and for all.

Enter shady lawyer Park Jun-young (Jung Woo). Park is not your usual pick for a social justice case. He became a lawyer for the big bucks and macho posturing. After he loses a big case, incurs numerous debts, and is left by his wife and child, Park joins a big firm on a pro-bono basis, hoping to pick up a big client, impress them and get another permanent position. Thus he stumbles on Hyeon-woo’s case and, given the notoriety of the incident, thinks there may be some mileage in it.

Park may start off as the cynical, winner takes all school of legally savvy but morally bankrupt attorney but the more he looks into Hyeon-woo’s case the angrier he finds himself getting. Not only was Hyeon-woo betrayed by the police who knew the identity of the real killer but chose to scapegoat a poor boy instead, but he was also ordered to pay vast sums in compensation to the victim’s family. Saddled with an irreparable debt for a crime he did not commit, Hyeon-woo has reason for his passive aggressive defeatism and lack of faith in Park but gradually begins to come back to life when provided with real hope of achieving his goal of a new trial.

Yet much of the drama revolves around the two as they negotiate an uneasy trust. Hyeon-woo has been let down before by men in who said they could help only to make a speedy exit taking Hyeon-woo’s hard won money and faith in the future with them. Park starts off claiming Hyeon-woo’s guilt or innocence is an irrelevant detail, all that matters to him is winning the case and thereby getting his career back on track. Flitting through periods of winning and losing faith in each other the two are eventually able to come together in their common goal, each working for justice not just for Hyeon-woo but for all the other Hyeon-woos betrayed by political and judicial corruption.

The real life case which inspired New Trial is still not settled but the man who inspired the originally slippery Park has gone on to become Korea’s new trial king – coming to the rescue of those who find themselves at the mercy of shady forces and railroaded into paying for something they did not do. Park finds few allies in his new quest for social justice, and none among the ranks of the swanky lawyer elites he was so desperate to join, but every movement needs a leader and perhaps this one starts with a man called Park and a massive change of heart.
